Terms of Use
These terms are an agreement between you and Lume Watch LLC, a Texas limited liability company, covering your use of the Fossick iOS app. By using Fossick you agree to them. Apple's Licensed Application End User License Agreement also applies to your use of the app. If these terms and Apple's agreement conflict, Apple's agreement controls where required.
What Fossick does, and what it does not promise
Values are estimates. Fossick uses AI and recent marketplace sold data to estimate what an item might resell for. Estimates are informational only. They are not professional appraisals, not an offer to buy, and not a guarantee that your item will sell at any price. Item identification can be wrong, markets move, and condition matters. Always use your own judgment before spending money.
Fossick is a research tool for people who source and resell secondhand goods. You are responsible for your own buying and selling decisions and for complying with the rules of any marketplace where you sell.
Free scans and Fossick Pro
New accounts get 3 free scans. Continued use requires Fossick Pro, available two ways:
- Fossick Pro Monthly. An auto renewing monthly subscription at $8.99 a month in the United States, billed to your Apple Account when you confirm. It renews automatically each month unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. Manage or cancel it anytime in your iPhone Settings under your name, then Subscriptions.
- Fossick Pro Lifetime. A one time purchase that grants Fossick Pro access for the life of the product, meaning for as long as Lume Watch LLC commercially offers and operates the Fossick app. Lifetime refers to the life of the product, not the life of the purchaser, and does not obligate us to operate the service forever.
Fair use scan limits
Every scan costs us real money to process, so Fossick Pro includes generous fair use limits: 100 scans a month on Monthly and 150 scans a month on Lifetime. Limits reset each month. We may lower limits only for accounts that abuse the service. Everyone else keeps the limits they bought.
Billing, cancellation, and refunds
All payments are processed by Apple through your App Store account. Cancel subscriptions anytime in your device Settings. Refunds are handled by Apple under App Store policies; you can request one at reportaproblem.apple.com.
Your account and conduct
Keep your account credentials to yourself. One account is for one person. You agree not to abuse the service, including attempting to circumvent scan limits, scraping or reselling our data or results, reverse engineering the app, or using Fossick for anything unlawful. We may suspend accounts that abuse the service.
Content you submit
You keep ownership of your photos. You give us the limited license needed to process them and operate your account features, such as your saved find log. We do not use your photos to train AI models.
Intellectual property
Fossick, the Fossick name, and the app's design and content belong to Lume Watch LLC. Marketplace data is provided through official APIs and belongs to its respective owners.
Disclaimers and limits on liability
Fossick is provided as is, without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent the law allows, Lume Watch LLC is not liable for indirect, incidental, or consequential damages, including lost profits from buying or selling decisions. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Changes to the service or these terms
We may update Fossick and these terms over time. For meaningful changes we will update the date above and note the change in the app. Continuing to use Fossick after a change means you accept it.
Governing law
These terms are governed by the laws of the State of Texas, and disputes will be handled in the state or federal courts located in Bell County, Texas, unless applicable law requires otherwise.
